I have a friend who is selling her handgun and needs a sample Bill of Sale form, or what needs to be on a handgun bill of sale to protect her. She lives in Arizona if that makes a difference. She is selling the handgun to a friend of hers but just wants to be safe and protected in this transaction.

Dear DG,

It's not really a big deal as far as I know, just like selling a car. All she needs is something like this:

I (your friend's name) sold a (name of item) serial number (number) for the amount of (selling price) on (the date) to (name of buyer) who resides at (buyer's address). (your friend's signature)

I (name of buyer) am legally able to own and purchase firearms (signature of buyer)


Verifying the buyers age by seeing a driver's license wouln't hurt either and if so just record the license number after the buyer's name and address. Unless your friend has a reason to believe that the buyer cannot legally purchase a firearm legally there's no legal requirement (at least from the federal laws) that she question the buyer about it. When individual sales were legal in Maryland, I used the 4473 that I got from dealers. I had no authority to make the buyer fill it out, and wrong answers were not punishable, but the form itself scared off a couple of guys I didn't especially want to sell to anyway, and the information is all there.

Are you sure the wrong answers are not punishable? I am going through my CCW refresher course and the instructor said that having the buyer fill out the 4473 was a good idea because it is a federal form with punishments for entering wrong information.

The form itself states: "I also understand that making any false oral or written statment, or exhibiting any false or misrepresented identification with respect to this transaction, is a crime punishable as a felony."

I too, would suggest that your friend get a 4473 and require the buyer fill it out. Make sure she keeps it forever.

Buyer acknowledges and understands that he will read the Owner’s Manual. Feel free to edit as you need. They fill out and keep a copy and I fill out and keep a copy. It's not needed for private sales, but this is just more of a CYA for me. Sometimes I even put our CHL numbers on the Bill of Sale.
